You must be at least 18 years old and legally able to enter a binding contract to use the Service. You agree to provide accurate, current information when you register and to keep it up to date. One account per person.

Sellers create listings describing a vehicle they own or are authorized to sell. Buyers make offers and message sellers through the Service. If both sides agree, they complete the sale privately between themselves — payment, inspection, handover, and the transfer of title and registration all happen directly between buyer and seller, away from the Service.

Unsmoggables is not the buyer or the seller of any vehicle, is not a party to the sale contract, is not an escrow agent, is not a money transmitter, and does not act as a dealer, broker, or title service. We provide listings, messaging, and basic account checks only.

Because we never receive, hold, or release the purchase price, we cannot reverse a payment, force a delivery, or recover money for you. You choose how you pay and how you transfer the title, and you carry the risk of that choice.

If you want a neutral third party to hold the money, you and the other party may choose a licensed, bonded escrow company yourselves — for example Escrow.com. That company’s own terms govern the money; Unsmoggables is not a party to it, receives no part of it, and does not endorse or guarantee any provider. Never use an “escrow agent,” link, or invoice introduced to you by the other party.

Title, registration, smog and emissions paperwork, taxes, and any DMV filing are your responsibility and must follow the rules of your state.

We ask for basic account information and may ask you to verify a phone number so we can reduce fake accounts, spam, and impersonation. What we ask for and why is described on our verification page. A phone-verified badge means only that a phone number was confirmed. It is not an identity check, a background check, or any assurance about a person, a vehicle, or a sale.

Creating an account and publishing a vehicle listing is free. We do not charge a listing fee or a buyer fee.

We take no commission on a vehicle sale, and the purchase price never passes through us — you and the other party settle that privately.

We do sell optional paid add-ons, such as featuring a listing at the top of browse results or a vehicle history check. Prices are shown before you buy, each purchase is a one-time charge with no auto-renewal, and the add-on applies to your account or listing only — it is not a payment toward a vehicle.

Add-on payments are processed by our payment processor, Stripe. You enter your card details directly with Stripe; we never receive or store your full card number. Your purchase is also subject to Stripe's terms, and any chargeback or dispute is handled through Stripe.

Add-on purchases are generally non-refundable once the benefit has started, but write to us if something did not work as described and we will make it right. If we introduce new fees, we will tell you before they apply to you.

• You must own the vehicle, or have written authority to sell it, and have clear title.
• Your listing must be accurate and not misleading, including title status, odometer, condition, and any damage.
• You are responsible for completing the title transfer and for any taxes due on a sale.

• Inspect the vehicle and verify the VIN, title, and odometer before you pay anything.
• Choose a payment method you are comfortable with — we cannot recover funds you send.
• Complete the registration and title paperwork required in your state.

Many vehicles listed on the Service are modified, tuned, swapped, or unable to pass an emissions or smog inspection in some states. Emissions, inspection, registration and equipment rules differ by state and change over time, and a vehicle that is legal to own, sell or register in one state may not be in another.

Sellers must accurately describe a vehicle’s emissions equipment and modifications, including any deleted, disabled, altered or non-original emissions components, and must follow every disclosure rule that applies to them. Buyers are responsible for confirming that a vehicle can be legally purchased, transported, registered, inspected and operated where they live, before they pay anything.

Nothing on the Service — including listings, guides, journal articles, and resource pages — is legal, mechanical, emissions, tax or regulatory advice, and Unsmoggables makes no representation that any vehicle complies with federal, state or local emissions law. You must not use the Service to arrange or promote conduct that is unlawful in your jurisdiction, including tampering with emissions controls where prohibited.

You must not, and must not attempt to:

• Use the Service for anything other than a genuine vehicle sale, including laundering money or arranging payments unrelated to a vehicle.
• Create listings for vehicles you do not own or are not authorized to sell.
• Misrepresent a vehicle’s title, mileage, condition, or history.
• Pressure another user into an unusual payment method, gift cards, or an “escrow agent” you introduce.
• Share or publish another user’s contact or payment details.
• Impersonate another person or use another person’s identity or bank account.

Violations can result in removed listings, account suspension, and referral to authorities where required by law.

You retain ownership of the content you post (photos, descriptions, your listing). You grant Unsmoggables a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for format or size only) and display that content (a) on the Service for the purpose of operating the marketplace, and (b) off the Service to promote and advertise the Service and its listings, including in advertising, email, social media and other marketing, with attribution where practical. This licence continues after a listing is withdrawn, sold or removed, for content posted while these terms applied. You may ask us to stop using your content in off-Service advertising by emailing support@unsmoggables.com, and we will stop using it in new advertising within a reasonable time. We may remove any listing that we believe violates these terms or the law.

You must have the right to post everything you upload. Do not post photos, text or video taken from another listing, a dealer site, a manufacturer, or a photographer without permission.

We may make limited corrections to a listing for safety, privacy, legal or policy reasons — for example removing a phone number, address, licence plate or other personal information, correcting an obvious typographical error, or removing or reordering a photo you uploaded. We do not add content to your listing and we do not upload photos to it. Every such change is recorded and you are notified. A listing remains your statement about your vehicle and you remain responsible for its accuracy; if you disagree with a correction you may edit the listing yourself or withdraw it.

If you believe content on the Service infringes your copyright or other rights, or is unlawful, email support@unsmoggables.com with: the URL of the content, a description of the work or right involved, your contact details, a statement that you believe in good faith the use is not authorised, a statement under penalty of perjury that your notice is accurate and that you are the rights holder or authorised to act for them, and your physical or electronic signature.

We review complete notices and may remove or disable the content. The person who posted it may send a counter-notice with the same detail, and we may restore the content if we receive one and no legal action follows. We may suspend or close accounts that repeatedly infringe, and we may forward notices, including your contact details, to the person who posted the content.

Unsmoggables may send messages between buyers and sellers through the Service, and may send you account alerts by email. With your separate opt-in, we may also send text messages — sign-in security codes and account alerts — under the terms shown on our text message opt-in page. You can opt out at any time by replying STOP to any text, or from your account settings.

The Service links to and mentions companies we do not control — escrow providers, vehicle transporters, inspection services, history-report providers, government sites and others. Those links are for convenience only. We do not endorse, vet, guarantee or take responsibility for any third party, their pricing, their availability, or the work they do, and any dealing with them is entirely between you and them, under their terms.

Payment processing for optional add-ons is handled by Stripe under its own terms; we do not receive or store your full card details. Text messages are delivered by our messaging provider and carrier delays or failures are outside our control.

The Service is provided “as is.” We do not guarantee that listings are accurate, complete, or that any vehicle is as described — that is the responsibility of the buyer and seller. We do not vouch for any user, and we offer no payment protection, buyer guarantee, or refund of any kind, because we never receive the money. We may suspend or change the Service for maintenance, security, or legal reasons without notice.

To the extent permitted by law, Unsmoggables is not liable for indirect, incidental, or consequential damages arising from your use of the Service, and is not liable for any loss arising from a payment you make, a vehicle you buy or sell, or paperwork you file. Our total liability for any claim arising out of the Service is limited to the greater of the fees we charged you or one hundred US dollars. Nothing here limits liability that cannot be limited under applicable law, such as liability for gross negligence or wilful misconduct.

You agree to indemnify and hold Unsmoggables harmless from claims arising out of your listing, your offer, your breach of these terms, or your violation of any law.

We may suspend or close an account that violates these terms, that we believe is connected to fraud, or that presents a legal or security risk. You may close your account at any time.

We keep account details, listings, and the messages exchanged on the Service for as long as your account is open and for a reasonable period afterwards, so we can resolve disputes, prevent fraud, and meet legal obligations.

We may update these terms from time to time. If we make a material change, we will notify you through the Service or by email. Continued use after the effective date means you accept the updated terms.

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.

Informal resolution first. Before starting arbitration, you agree to email a written description of the dispute to support@unsmoggables.com and give us 30 days to try to resolve it. We will do the same for any claim we have against you.

Binding arbitration. If we cannot resolve it, any dispute arising out of or relating to these terms or the Service will be settled by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules, before one arbitrator, seated in Los Angeles County, California. The arbitrator decides all issues, including the scope and enforceability of this clause. Judgment on the award may be entered in any court with jurisdiction.

Class action and jury waiver. Disputes are brought only in an individual capacity. Neither you nor Unsmoggables may bring a claim as a plaintiff or class member in a class, collective, consolidated or representative action, and the arbitrator may not award relief to anyone who is not a party. You and Unsmoggables waive any right to a jury trial. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies.

Exceptions and opt-out. Either party may bring an individual action in small-claims court, and either party may seek injunctive relief in court to protect intellectual property or stop unauthorized access to the Service. You may opt out of arbitration by emailing support@unsmoggables.com within 30 days of first accepting these terms, with your name and account email; opting out does not affect the rest of these terms.

Time limit. Any claim relating to the Service must be filed within one year after it arises, or it is permanently barred, except where a longer period is required by law.
